PRIVACY POLICY

Thank you for using Noice! In this Privacy Policy, we explain how we collect and use your personal data about you when you use Noice’s site, mobile application or our other services (together referred to as the “Service”), and the rights and options you have concerning your personal data.
1. How to Contact Us
For the purposes of this Privacy Policy, the data controller is Noice Entertainment Oy (“Noice” or “we” or “us”). We are registered in Finland under Business ID 3150031-5. Our registered office is at Vuorikatu 14, 00100 Helsinki, Finland.

2. Why Do We Collect Your Data?
Providing data to us is not mandatory. However, we are unable to provide the Service, or some parts or features of the Service to you, without processing your data. If you use our Service, we will collect your data as described in more detail below, depending on how you use our Service and the choices you make when using the Service. The purposes for which your data is collected are described in more detail in Section 4 below.
3. Data We Collect and Where
Data you provide to us
When you create your account:
- Your contact information (such as your name, e-mail address, phone number and other information you have provided when registering an account to our Service),
- Your date of birth (only the month and year will be stored to determine your eligibility to use the Service),
- Username and public user ID, and
- User avatar.
When you are using our Service to play Noice’s prediction game and watch streams:
- Chat messages sent by you through the Service,
- Your messages or other communications you send us (user support messages),
- Content reports made by you,
- Your activities on the Service (such as your use of virtual items, progression, gameplay actions, watched streams and videos, your interactions with ads in our Service, and login dates),
- Your in-app browsing, transaction amounts, payment method selection, and purchase history
- Your interactions with other users of the Service (such as friends and gameplay with other users),
- Data you provide in connection with surveys, promotions, sweepstakes, competitions and other events, and
- Your content preferences or other information you submit to us (for example, if you subscribe to our communications), and
- Results of third-party age-verification checks required to access certain content or parts of the service, excluding details on how the age was verified, and
- Any other information you choose to give us.
When you are using our Service to stream:
- Your video stream and information about the game you are playing and your gameplay (such as your gamertag, the name of the game, your actions in the game and your progress in the game),
- Information you provide about your channel, your streams and yourself as a streamer (such as your location, descriptions, channel name, channel information, alternate social media channels, preferences, your likeness, and age),
- Results of third-party age-verification checks and/or parental consent confirmations you may be required to complete to become eligible to use the Service to stream,
- Videos, images, emojis and photos you upload to the Service to be used in your channel,
- Videos, images or text you may upload for appearance on your streamer cards,
- Chat messages sent by you through the Service to your channel’s chat and other communications with users through the Service, and
- If you monetize your channel and your User Content, your payment data, including your full name, email address, home address, bank details and other payment information, tax withholding information, and date of birth.
Data we collect automatically when you are using our Service
- Your IP address or mobile device identifiers and approximate location (e.g., country or territory),
- Data about your device, such as device name, operating system, operating system version, browser type and language.
- Crash logs or other information related to bugs, errors, or other issues in our Service, and
- With your consent, other information explained to you when asking for your consent.
Data we collect from our partners
- If you make purchases in our Service, we collect information about your purchases and order history, as well as information we receive from third-party payment service providers to validate your purchases.
- Data from cloud platforms that the Service run on,
- Data for advertising and analytics purposes in order to improve and customize your user experience, and
- Data to fight fraud (such as click fraud in advertising).
Data from third-party services
If you link a third-party service with the Service (such as your Facebook, Discord or Google account) or join Noice’s Discord server, we collect data from those providers for purposes of enabling that linkage, such as your account/contact information and Discord activity. This Privacy Policy does not govern or cover the privacy practices of third parties. We encourage you to review their privacy policies to learn more about their practices.
4. Purposes for Which We Collect your Data
We collect your data to perform the contract. In practice, this means that we may collect and process your data that is necessary to:
- enable you to use our Service and communicate with other users of the Service,
- provide and deliver virtual goods and virtual currencies ("Virtual Items”) you purchase and verify such purchases in the Service,
- respond to your comments and questions and provide user support, and
- send you messages and information related to the Service.
To provide, maintain and improve the Service to our users, we have a legitimate interest in collecting and processing your data necessary to
- operate and maintain our Service,
- update and develop user profiles,
- develop and improve the Service and user experience,
- handle your support requests or otherwise manage our relationship with you,
- customize your service experience (like language version), and
- provide you offers in the Service.
We may provide you with relevant ads in our Service based on our legitimate interest in promoting and funding our Service. In order to do that, we may process your data to:
- send you communications related to our Service,
- track your activity in our Service to learn about your interests to improve and target advertising in our Service,
- show ads in our Service, and
- request our advertising partners to advertise our Service to audiences that they believe have similar interests to yours, subject to legal and policy restrictions related to targeted advertising.
To keep our Service safe and fair, to fight fraud and ensure the acceptable use of our Service, we have a legitimate interest in processing necessary data to
- analyze and monitor the use of our Service and ensure that our Terms of Service for Content Creators, Terms of Service for Users (together “Terms of Service”), and Community Guidelines are followed,
- moderate and monitor the use of our Service (including any User Content broadcasted through the Service or uploaded to the Service and messages sent through the Service), either automatically or manually, and
- Take action against users that breach our Terms of Service or Community Guidelines or act otherwise fraudulently or misbehave.
With your consent, we may process your data to
- send you newsletters, notifications or other similar communications if you have subscribed to them, and
- other purposes explained to you when we ask for your consent (for example, using your location).
Finally, we may process your data as necessary to:
- comply with legal obligations that we believe apply to us, and
- protect your vital interests or the vital interests of another person.
In addition, we may process your data for additional purposes that are compatible with any of the purposes listed above.
We do not use your data to make automated decisions that significantly affect you.
5. Who Can see Your Data?
To achieve the purposes described herein, we may share your data with the following types of recipients:
Service providers working for Noice
We may employ third-party providers to perform services for us. These providers process your data only at and according to our instructions in order to provide the Service for you. These external services can be, e.g., hosting, data storage, age verification, user support, promotion of Noice, payment processing, analytics, moderation, and fraud prevention.
Other companies and public authorities
To combat fraud and illegal activity, we may exchange data with other companies and organizations. We also provide it to public authorities in response to lawful requests.
We also reserve the right to disclose data in connection with, or during negotiations of certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
We may also disclose your data based on your explicit consent, to comply with the law, or to protect the rights, property or safety of us, our users or others.
Advertising Partners
We may work with third-party ad networks, advertisers and providers of analytics services for the purpose of measuring the performance of ads and of ad targeting to you, both on Noice and off the service. These third parties may collect, and we may share, data including cookies, your IP address or mobile device identifiers, pages visited, your location and time of day. We may also combine and share data we have collected about you with third-party advertising partners, who may use this data (and data from other services) to deliver targeted advertisements to you. Those services and partners may access your data and operate under their own privacy policies, which we do not control, and this Privacy Notice does not apply to the tracking technologies used by advertisers on Noice. Data You Share
Data that you make publicly available through the Service (such as streams and Discord posts/comments) will be available to other users and/or the public.
6. Cookies
We and our partners may use cookies (text files that are transferred from our Service to your computer to collect standard internet log information and visitor behavior information) or similar technologies to help us provide and personalize the Service for you, analyze the use of the Service, target advertisements and prevent fraud. Please note that our partners may operate under their own privacy policies.
If you wish to limit behaviorally targeted advertising, you can control the use of cookies, for example, by disabling some or all cookies or configuring your browser or device to notify you when cookies are being set. However, please consider that disabling cookies may affect your ability to use the Service.
7. Age Limit
Protecting children and their privacy is very important to us. In accordance with our Terms of Service, you must represent that you are at least 13 years old to use the service. You may also need to prove your age with a third-party age verification service. If you are under 13 years of age, you may not use the Service, and you should not provide your personal data to us.
If we discover that we are processing the personal data of a person under 13 years, we will take appropriate measures to promptly delete the data from our records and suspend or delete the account without any personal data. If you have reason to believe we hold personal data relating to a user under 13, please contact us.
8. International Data Transfers
In connection with the processing activities described in this Privacy Policy, your data may be transferred to and/or processed in countries outside the European Union (“EU”) and the European Economic Area. Because different countries may have different data protection laws than your own country, we take steps to ensure adequate safeguards are in place to protect your data, as explained in this Privacy Policy. The safeguards that our partners may use include standard contractual clauses approved by EU Commission and other lawful safeguards.
9. Your Rights and Options
You have the following rights concerning your data:
- access the personal data we hold about you,
- correct or request deletion of your data,
- request us to restrict the processing of your data,
- object to the processing of your data to the extent our processing is based on our legitimate interests or the legitimate interests of a third party, or
- where technically feasible, request a copy of the personal data you have provided to us in a machine-readable format.
If the processing of your data is based on your consent, you have the right to withdraw your consent at any time. Please note that we may continue processing your data despite your withdrawal of consent if we have another lawful basis to process that data.
To unsubscribe from our marketing communications, please use the unsubscribe link provided in the messages we send. The unsubscribe link is typically found at the end of the message.
You can exercise these rights by contacting us as described above. We may verify your request by asking you to provide information related to your recent interactions with us, such as the last time you logged on. If we deny your request, you may appeal our decision by contacting us at legal@noice.com . If you have concerns about the results of an appeal, you may contact the attorney general in the state where you reside. We will respond to all requests within a reasonable timeframe. If you have an unresolved privacy or data use concern that we have not addressed satisfactorily, please contact us. You may also contact your local data protection authority within the European Economic Area for unresolved complaints.
10. How long do we Retain your Data?
We retain your data for as long as your Account is active or as long as necessary to achieve the purpose(s) for which your data was collected. We may periodically delete or de-identify inactive Accounts or other data in our Service.
After the applicable retention period, we will either delete or de-identify your data. We may continue to use data that is not identifiable to you (for example, aggregate data).
If you ask us to delete your personal data, that data will be removed within 30 days (or as legally required), provided that we do not have any other obligation or legitimate business interest to retain your data. Note that if you ask us to remove your personal data, we will retain your data as necessary for our legitimate business interests, such as to comply with our legal obligations, resolve disputes, and enforce our agreements.
